Many buildings in Boston, the Commonwealth of Massachusetts, and the rest of the United States were built during an era when asbestos was used in virtually every aspect of production. While the asbestos was very dangerous to those who manufactured the products and to the workers who installed them, residents and occupants of the building are usually not at risk.

vermiculiteThe reason for this is because asbestos is only dangerous when it is inhaled, and, if there is asbestos in the walls, for example, there is not much risk of inhaling the deadly fibers. However, if the fibers are disturbed, the asbestos can become friable, which means that it is capable of being crushed by the pressure of the human hand. Once this happens, it becomes very dangerous. Palmer v. 999 Quebec, Inc, a case from the Supreme Court of North Dakota, involved a plaintiff who was born in 1955 and was raised in Duluth, Minnesota. He was diagnosed with malignant mesothelioma in 2011. He died four years later in 2015.

shotKuettel, a predecessor in interest to the named defendant, supplied and installed insulation that contained large amounts of asbestos. Plaintiff’s father worked for this company for several years in the 1960s and 1970s when plaintiff was a child. Plaintiff alleged that he was routinely exposed to deadly asbestos fibers when his father would come home from work still covered with dust from the asbestos insulation products he was installing at commercial sites. Asbestos abatement (removal) must be performed by a certified contractor with employees that are properly trained in asbestos safety and who are provided with proper protective clothing including respirators or ventilators. All asbestos abatement must be done after obtaining permits from the Massachusetts Department of Environmental Protection (MassDEP). Once proper permits are in hand, the work must be done in such a way that insures workers and those in the surrounding community are not exposed to deadly asbestos fibers.

respiratorThere are a lot of ways to accomplish this. The area is generally tented off or otherwise sealed, and asbestos material itself may also be sealed prior to removal. In some cases, the asbestos removal workers will paint the material with a thick coat of industrial sealant to make sure the fibers cannot escape. This is similar to lead paint removal on bridges and other outdoor structures.   Once the asbestos debris is removed, it must be kept wet at all times to prevent dust from flying into the air, and then it must be secured in approved plastic containers. These containers must be kept sealed and transported to an approved hazardous waste facility. Residents of Westford, Massachusetts are proud of the Roudenbush Community Center building that has brought so much enjoyment to the area after it was converted to a community center in the mid 1970s. It was originally built as a private school, and, at the time, the designers spared no expense. The building was intricately designed and filled with architectural treasures. Even the railings on the staircases feature detailed carvings done entirely by hand.

vintage-hotel-1380443-mWhile the building has been added to the historic registry, it has become a victim of its age, and it is starting to deteriorate to the point where it is causing safety concerns among residents and town officials.   For this reason, town residents are pushing their elected officials to allocate enough money from budget to restore the building to its former glory. However, due to the high cost and amount of work involved, the town officials are not sure what they will be able to do, according to a recent news article from Wicked Local Westford. While asbestos has not been used in construction in the United States for over two decades, it is well known that many older buildings in the greater Boston area contain large amounts of deadly asbestos fibers. For the most part, these fibers are not a threat to the occupants of the buildings unless the buildings are in a deteriorating state or building owners perform renovations or demolition work.

Unfortunately, they know that it generally takes between 20 and 50 years for the asbestos fibers to cause malignant mesothelioma, and the victims often have no idea that they are sick. When asbestos is removed from a building during a demolition or renovation process, the asbestos must first be inspected by a certified asbestos contractor and sent to a hazardous materials testing lab for confirmation that the substance is, in fact, asbestos. After the presence of asbestos is confirmed, a building owner, with the help of a certified asbestos abatement contractor, must submit an asbestos abatement plan to the Massachusetts Department of Environmental Protection (MassDEP) and apply for an asbestos abatement permit.

mjzWfFiOnce the permit is granted, a certified asbestos abatement contractor must perform the work with properly trained employees who are provided with required safety equipment, including protective clothing and respirators or ventilators. The asbestos must be removed carefully, so as to prevent anyone from being exposed to the deadly fibers. This may involve painting exposed asbestos with a heavy coat of sealant to prevent dust from escaping. Regardless of what is needed to remove the asbestos-laden materials, the material must be wet down to suppress most of the dust and placed in approved containers. The containers must be sealed and taken to an approved hazardous waste disposal center. Sometimes, this involves taking the asbestos to an approved recycling center. Continue reading

Even if you have never been there, most people are familiar with what the giant silver arch in St. Louis looks like. It is a must see for anyone visiting St. Louis or traveling through the area.   The Gateway Arch is the largest of its kind in the world and is part of the Westward Expansion Museum. There is an elevator in the arch that takes riders to the top, so they can look through observation windows.

The arch was constructed in the 1950s, and it is not surprising that asbestos was heavily used during the construction, because such use was very prevalent during that time in American history. Asbestos is a naturally occurring mineral that is actually comprised of six different strains of silica. On the corner of D and Athens Street in South Boston sits a red brick building that served as South Boston’s main police station for just less than 70 years before it finally closed in the early 1980s. Since its closure, the building sits empty, and it has for many years, but city officials hope that will not be the case for much longer.

When people think of where United States Congress members work, they are often picturing the iconic United States Capitol building in Washington, DC. While the Capitol building is certainly where Congress members go to vote on bills and speak on the floor of the House and the Senate, only a few longstanding members of Congress actually have offices in the Capitol building, because there simply isn’t enough space. For this reason, there are several congressional office buildings located next to the Capitol building, such as the Hart building and Cannon House Office Building that houses over 100 members of the United States House of Representatives and their respective staff.

It should be noted that the Architect of the Capitol (AOC) is not a person but the federal agency responsibly for maintaining the condition of the many federal buildings on Capitol Hill and for handling any major construction or renovation projects. According to a recent public letter from the United States Office of Special Counsel to President Barack Obama, a whistleblower’s claims of asbestos safety violations at a Veteran’s Administration (VA) hospital have been substantiated.

whistle-1505616The reason the letter was addressed to the president is because, as president, he is technically in charge of all executive agencies. According to the release, federal investigators responded to a whistleblower’s claim that, as long-time maintenance employees, he and his co-workers, which included pipefitters, HVAC workers, and plumbers, had to work every day in areas VA knew to contain asbestos. Whistleblower also said he and others were required to perform their work without the use of certified or approved asbestos protection equipment or respirators or ventilators. It also seemed to whistleblower that they were taking this toxic asbestos-laden material and throwing it in an ordinary dumpster. Continue reading
